STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (d) OF STARRED QUESTION NO. 264 TO BE ANSWERED IN THE LOK SABHA ON 15.03.2001 REGARDING FOREIGN AND PRIVATE INVESTMENT IN POWER SECTOR.

(a) & (b) : Under the policy to encourage greater private sector participation in the power sector announced in October, 1991, private sector units can set up thermal projects-coal/lignite or gas based, hydel projects and wind/solar energy projects of any size. As per the policy, up to hundred percent (100%) foreign equity participation can be permitted for projects set up by foreign investors. A statement indicating private sector power projects proposed to be implemented through foreign/private investment and techno-economically cleared by the Central Electricity Authority (CEA) is at Annexure-I.

(c) & (d) : Normally, the private power projects do not sell electricity directly to the domestic/agricultural and/or other small consumers and sell it to the State Electricity Power Transmission Corporations/State Electricity Boards (SEBs). The tariff of electricity supplied from private projects is determined as per the provisions of the two part tariff notifications dated 30th March, 1992 and the Power Purchase Agreement entered with the SEB. The tariff for thermal projects awarded on the basis of competitive bidding is governed by an amendment dated 23rd May, 1997 to the tariff notification. The tariff from the power plant is also dependent on various factors like site of project, type of fuel and its source, financing sources, sourcing of equipment etc. Under the provisions of the Electricity Regulatory Commissions Act 1998, tariff of intra state projects is determined by State Electricity Regulatory Commissions and by the Central Electricity Regulatory Commission for inter state projects.
