Question : GUIDELINES FOR STATE UNIVERSITIES



(a) whether the University Grants Commission`s guidelines are not binding on State Universities;

(b) if so, the details thereof;

(c) whether the professors and other staff of the State Universities are governed by the rules of the State Government; and

(d) if so, the details thereof?

(a) & (b): The University Grants Commission (UGC) Act, 1956, enacted by the Central Government, by virtue of Entry 66 of list I (Union List) of the VIIth Schedule of the Constitution of India, for the coordination and determination of standards in universities, stipulates that the UGC shall make regulations consistent with the Act on matters listed in section 26(1) of the Act. These regulations specify the higher educational institutions to which they are applicable. The UGC Regulations are binding on even the State Universities if it is so specified. In addition, guidelines are also issued by the UGC to implement schemes and matters of subsidiary importance related to the mandate of the UGC. (c) & (d): The UGC (Minimum Qualifications for Appointment of Teachers and other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards) in Higher Education Regulations, 2010 specify the minimum qualifications that are required for the appointment of teaching staff to universities and colleges including State Universities. However, the pay scales of teaching staff in State Universities are governed by the rules of the State Government only. Other personnel matters are governed by the respective Act/Statute/ Ordinance governing the State University.
