Question : Penalty for Defecation in the Open

Will the Minister of URBAN DEVELOPMENT be pleased to state:

(a) whether the Union Government has asked the State Governments to amend their municipal laws to incorporate provisions for spot fine, penalty or cleaning charge from people caught defecating in the open;

(b) if so, the details of guidelines issued to State Governments/UTs in this regard;

(c) whether on the basis of directives/guidelines the State Governments/UTs have amended their municipal laws to ensure that the violators are punished ; and

(d) if so, the details in this regard and further steps taken to effectively implement the scheme across the country?

(a) to (d): The State Governments have been advised to make the relevant municipal by-laws in this regard. At the same time State Governments have also been recommended to make provision of door to door collection of garbage and adequate number of garbage bins in all the wards in all cities by 30th September 2018.
Availability of public toilets within a distance of one kilometer in commercial areas has been made a precondition for declaring the cities/wards as open defecation free.
Making of by-laws and levying fines for littering, open defecation and public urination is a State/ULB matter.
