Question : NATIONAL REHABILITATION AND RESETTLEMENT POLICY



(a) whether the Union Government takes any action on non-compliance of the provisions of the National Rehabilitation and Resettlement Policy, 2007 by various Departments/State Governments/ Authorities;

(b) if so, the details thereof and if not. the reasons therefor; and

(c) the corrective measures taken by the Government in this regard?

(a) to (c): Government of India adopted the National Rehabilitation and Resettlement Policy, 2007 on 31.10.2007. The principles of this policy apply to the rehabilitation and resettlement of persons involuntarily displaced permanently due to land acquisition and any other rdason. Provisions of the National Rehabilitation and Resettlement Policy, 2007 have largely been adopted in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013. Chapter-IX of the said Policy entails constitution of the National Monitoring Committee for reviewing and monitoring the progress of implementation of rehabilitation and resettlement schemes or plans relating to all cases to which this policy applies. Accordingly, National Monitoring Committee was constituted on 24.07.2008 under the Chairpersonship of Secretary, Department of Land Resources.

Later, the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement (RFCTLARR ) Act, 2013 was passed by the Parliament and came into effect on 01.01.2014. Section 48 of the said Act provides for establishment of National Monitoring Committee for Rehabilitation and Resettlement to review and monitor the implementation of Rehabilitation and Resettlement schemes or plans under the Act. Thus, National Monitoring Committee was reconstituted on 29.08.2014 to review and monitor the implementation of rehabilitation and resettlement schemes or plans under the RFCTLARR Act, 2013 and National Rehabilitation and Resettlement Policy, 2007. First meeting of the reconstituted Committee was held on 20.01.2015.

To review and monitor the implementation of rehabilitation and resettlement schemes or plans under the RFCTLARR Act, 2013 and National Rehabilitation and Resettlement Policy, 2007, two National Monitoring Committees were constituted on 02.03.2015, one to look into displacement schemes and plans due to land acquisition and the other to look into displacement schemes and plans due to reasons other than land acquisition.
