Question : Disposal of Commercial Disputes


(a) whether the Government proposes to set up commercial courts in the country for expeditious disposal of commercial disputes and other issues related to foreign direct investments;

(b) if so, the details and the present status thereof;

(c) whether the Arbitration and Conciliation (Amendment) Bill, 2015 and the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015 have been enacted;

(d) if so, the details thereof; and

(e) the extent to which the ease of doing business in the country is likely to improve as a result of enactment of these two Acts?

(a)to (e): The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015 and The Arbitration and Conciliation (Amendment) Act, 2015 have been enacted and received assent of the President on 01.01.2016. Provision have been made in Section 3,4 & 5 of the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015 for enabling the constitution of the Commercial Court at district level and Commercial Division and Commercial Appellate Division in the High Courts. Enactment of these two Acts will help in improving the contract enforcement and ranking in ease of doing business and shall result in expeditious disposal of commercial and other disputes.
