Question : Monitoring Mechanism in Orphanages and Child Care Institutions

(a) whether the Government has prepared any database of children living in orphanages and Child Care Institutions (CCIs) in the country to ensure their safety and welfare;
(b) if so, the details thereof, State/UT-wise;
(c) whether the Government has received complaints regarding ill treatment of children in such orphanages and CCIs and if so, the details thereof, State/UT-wise along with the action taken thereon;
(d) whether the Government has any regular monitoring system regarding their welfare, education, quality of food, training and employment therein; and
(e) if so, the details of social audit and the present status of the institutions thereof?

(a) & (b): As per the information provided by the State/UT governments, the number of Child Care Institutions (CCIs) including Specialised Adoption Agencies (SAAs) registered under the Juvenile Justice (Care and Protection of Children) Act, 2000/2015, which are being supported under the Integrated Child Protection Scheme (ICPS), is at Annexure-I.

(c): The National Commission for Protection of Child Rights (NCPCR) has reported that it has registered 14 complaints regarding ill treatment of children in CCIs including SAAs during the year 2016-17 and current year 2017-18 is at Annexure-II.

(d): The Central Government is executing Integrated Child Protection Scheme (ICPS) to implement the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015 (JJ Act), in which State Governments/UT Administrations have major role to play. The Ministry has been requesting the State Governments/UT Administrations from time to time to identify and register all CCIs including SAAs under relevant provisions of JJ Act and set up functional inspection and other Committees to ensure that children in all the CCIs receive the best of care, and are not subject to any kind of abuse and neglect. As and when any such information is received, the State Governments/UT Administrations is requested to conduct inquiry under intimation to the Ministry and take corrective measures.



Under ICPS financial assistance is provided to the State Governments/UT Administrations for setting up, upgradation and maintenance of various types of Children Homes and SAAs under the ICPS. The Rules inter-alia specify standards for physical infrastructure, clothing, bedding, nutrition & diet, as well as rehabilitation measures such as education, vocational training, counselling etc. The State Governments/UT Administrations are required to ensure, through regular inspection and monitoring, that the institutions are run as per the provisions of the Act and the Rules framed there-under.

(e): As per Section 110 (1) of JJ Act State Government is required to make rules to carry out the purpose of this Act. Under the proviso of this Section Central Government may frame model rules in respect of all or any of matters with respect to which the State Government is required to make rules and where any such model rules have been framed in respect of any such matters they shall apply to the State mutatis mutandis until the rules in respect of that matter are made by the State Government and while making any such rules, they conform to such model rules. As such Model JJ Rules, 2016 has been notified by the Central Government, in addition to this MWCD is executing ICPS since, 2009 for execution of JJ Act and for well being of children in difficult circumstances, which includes provision for social audit.
