Question : DIVA SAWANTWADI TRAIN DERAILMENT



(a) the number of persons injured and killed in the Diva-Sawantwadi passenger train derailment in Maharashtra’s Raigad district;

(b) whether any inquiry has been conducted to identify reasons for the accident;

(c) if so, the details thereof; and

(d) the amount of compensation announced by the Railways for the wards of those killed in the incident?

(a): 23 passengers lost their lives, 83 sustained injuries (Grievous- 34 and Simple- 49) in the derailment of Diva-Sawantwadi passenger train in Raigad District of Maharashtra.

(b) & (c): Yes, Madam. A statutory inquiry into the derailment of Train No.50105 Dn Diva - Sawantwadi Road Passenger between Nagothane and Roha Stations on 04.05.2014 has been conducted by the Commissioner of Railway Safety, Central Circle under the Ministry of Civil Aviation. As per the preliminary report, the accident occurred due to ‘System Failure’.

(d): Compensation for death/injury in Train Accident/Untoward Incident (as defined under section 124/124-A of the Railways Act, 1989) is paid by the Railways after award of the decree by the Railway Claims Tribunal (RCT) in favour of the claimant on a claim of compensation filed with the Tribunal by the claimant and the decree so awarded by the Tribunal is decided to be satisfied by Railways. As no decree of the Tribunal has been received by the Railways so far, no compensation has been paid yet. However, 7 applications in case of death and one application in case of injury has been filed for compensation in RCT/Mumbai and order of RCT is awaited.

However, as a special case, on humanitarian grounds, the Railway administration had announced a relief of enhanced ex-gratia of Rs. 2 lakh for dead, Rs. 50,000/- for grievously injured and Rs. 10,000/- for those with simple injuries.
