Question : NCST

(a) whether any instance of noncompliance of recommendations of the National Commission of
Scheduled Tribes (NCST) by Delhi University regarding welfare of SCs/STs and their promotion in
University has come to the notice of the Government and if so, the details along with the reaction of
the Government thereto;
(b) whether any decision has been made recently regarding suspension of the present Executive
Director, SOL, Delhi University from his post, as recommended by NCST and if so, the details
thereof;
(c) whether any action has been taken by the Government in this regard so far and if so, the details
thereof and if not, the reasons therefor along with the time by which action is likely to be taken in this
regard; and
(d) whether the Delhi University Administration has moved to court against the NCST/HRD Ministry
in connection with the above NCST recommendations and if so, the details thereof?

(a) to (d) University of Delhi (DU) has informed that the promotion of SCs/STs employees of
School of Open Learning (SOL) could not be made as SOL does not have any sanctioned positions
from the Competent Authority. UGC has requested the university to submit a proposal for
amendment adding SOL as a University affiliated college in the statutes of the University after
getting the approval of its Executive Council. The University has not submitted the proposal.
The University has also informed that SOL has not taken any decision regarding suspension of
Executive Director and he has since superannuated on 30.06.2019. Further, the SOL has moved
Hon’ble High Court of Delhi for stay of the proceeding of the NCST and the Court has given stay
vide order dated 31.05.2019.
It is further submitted that the DU is a statutory autonomous institution established by an Act of
Parliament and competent to take decisions on all academic and administrative matters with the
approval of its statutory bodies i.e. Academic Council, Executive Council and the Court.
