Question : RESERVATION IN BANKS



(a) Whether the Government has issued directions to the banks regarding implementation of orders and judgments of the Hon`ble Madras High Court with respect to the reservation in promotion of bank officers/officials;

(b) if so, the details thereof;

(c) whether all the banks have implemented the above orders and judgments;

(d) if so, the details thereof and if not, the reasons therefor; and

(e) the steps taken/being taken by the Government for implementation of the said orders and judgments ?

(a) to (e) Yes, Sir. After the judgment dated 09.12.2009 issued by Hon`ble Madras High Court, the Government directed the Public Sector Banks on 01.02.2010 to implement the Department of Personnel & Training (DOP&T)`s Office Memorandum No. 36012/18/95-Estt. (Res.) Pt.ll, dated 13.08.1997. In the meantime the concerned five Banks viz. Union Bank of India, UCO Bank, Central Bank of India, Canara Bank and Syndicate Bank went in appeal in the Hon`ble Supreme Court of India against the judgment dated 09.02.2009 of Madras High Court. The Hon`ble Supreme Court in its interim order dated 15.03.2010 has issued directions `Status quo as of today shall be maintained until further orders`.

However, the Banks are following instructions contained in the DoP&T`s O.M. No. 36012/18/95-Estt.(Res.) Pt. II dated 13.08.1997 read in conjunction with DOP&T O.M. No. 10/41/73-Estt. (SCT) dated 20.07.1974 and further clarified by O.M. No. 36028/21/2008-Estt. (Res.) dated 29th July, 2008 which provide for reservation for SCs and STs in the matter of promotion by selection from Group `C to Group `B` , within Group B` and from Group lB` to the lowest rung of Group `A` posts (which is corresponding to Scale-I Officers Grade in the Banks).
