Question : Toll Plazas

(a) the details of toll plazas and the revenue earned from toll plazas during the last three years, State/UT-wise;

(b) the rules/guidelines that governs the collection of toll by contractors/ developers on NHs in the country including the procedure for remittance or appropriation of fees to the Government;

(c) whether State Governments or District Collectors particularly of Maharashtra, Kerala and Tamil Nadu are issuing arbitrary orders to stop toll collection or exemption to any category of vehicles on NH stretches;

(d) if so, the details thereof and total loss suffered by National Highway Authority of India (NHAI) or developers as toll loss;

(e) whether NHAI has asked the State to pay toll loss to compensate companies that are manning these stretches of NH; and

(f) if so, the State-wise demand made by NHAI and steps taken or being taken by Government in consultation with States not to issue arbitrary orders in this regard?

Answer given by the minister

(a) A list of State-wise user fee plazas under National Highways Authority of India (NHAI) is at Annexure-I and the collection from public funded toll plazas and revenue sharing from BOT (Toll) projects during last three years is at Annexure-II.

(b) The user fee rates are collected on the basis of applicable National Highways Fee Rules 1997/2008 as amended from time to time for a public funded project and as per provisions of the Concession Agreement for BOT (Toll/OMT) Projects.

Toll is being collected by NHAI on behalf of Ministry of Road Transport & Highways, Government of India. Further, the toll received by the NHAI is immediately being remitted to the Ministry Consolidated Fund of India.

(c) to (f) As per available records, a list of projects where concessionaires have raised claim due to lack of support from State Government or due to Court order is at Annexure-III.
