Question : Child Protection Policy of CCIs

(a) the total number of shelter homes and Child Care Institutions (CCIs) at present in the country along with the number of children residing in such homes/ units, State/UT-wise including Rajasthan, Maharashtra, Bihar and Jharkhand;
(b) the details of the crimes reported and complaints registered against CCIs and shelter homes along with the mechanism followed to register complaints made by the victims of crimes like rape;
(c) whether a nodal agency or a centre has been set up to create awareness among children at the shelter homes, where complaints can be registered and if so, the details thereof;
(d) the steps taken by the Government to rehabilitate the children from the 539 CCIs, that were shut down;
(e) whether action is being taken by the Government to improve the condition of the extant shelter homes, especially in terms of infrastructure enhancement and if so, the details thereof; and
(f) whether the Government proposes to amend the existing policy in this regard and if so, the details thereof?

(a): The total number of shelter homes and Child Care Institutions (CCIs) State/UT-wise including Rajasthan, Maharashtra, Bihar and Jharkhand being supported under the Child Protection Services (CPS) is at Annexure-I.

(b) & (c): The Government has legislated The Commissions for Protection of Child Rights Act, 2005 (CPCR), under which National Commission for Protection of Child Rights (NCPCR) and State Commission for Protection of Child Rights (SCPCRs) have been created as Statutory bodies for protection of child rights. The Commissions are mandated to monitor the implementation of the provisions of the Juvenile Justice (Child and Protection of Children) Act, 2015 (JJ Act) under Section 109 of the JJ Act, 2015. As reported by the National Commission for Protection of Child Rights (NCPCR), it has registered 140 complaints against CCIs and Shelter Homes during the last three years. The State/UT-wise details are at Annexure-II. There are various modes to register complaints with NCPCR by the victims which include writing directly to NCPCR; through POCSO E-box (ncpcr.gov.in/index2.php) and E-baalnidan (www.ebaalnidan.nic.in).

(d) to (f): Ministry is implementing Child Protection Scheme (CPS), and providing financial assistance, as Grant-in-Aid, to the States/UTs for, inter-alia, undertaking a situational analysis of children in difficult circumstances, for setting up and maintenance of various types of CCIs. The Juvenile Justice (Care and Protection of Children) Model Rules, 2016 framed under the JJ Act inter-alia specify standards for physical infrastructure, clothing, bedding, nutrition & diet, as well as rehabilitation measures such as education, vocational training, counseling, etc. JJ Act, mandates regular monitoring by Child Welfare Committees, Juvenile Justice Boards and State Governments. The Ministry stressed upon the need for mandatory monitoring as prescribed under the Juvenile Justice (Child and Protection of Children) Act, 2015 which mandates regular monitoring by Child Welfare Committees, Juvenile Justice Boards and State Governments. The primary responsibility in execution of the JJ Act lies with the State/UT Governments.

The Chief Secretaries of all the States/UTs were requested to get the inspection conducted under the supervision of District Magistrates. The Ministry also issued an advisory to the States and UTs regarding actions required to be taken in case of abuse of children in any Child Care Institutions.
