Question : Adoption of Abandoned Kids

(a) whether a large number of abandoned children are girls and only a few among them are adopted every year, if so, the details thereof;
(b) the details of the abandoned children living in Government and Non-Government shelter homes, State/UT-wise;
(c) whether the corruption and apathy has adversely affected the adoption process in the country and has reduced it to a commercial transaction;
(d) whether Central Adoption Resource Agency (CARA) has failed to regulate placement agencies, avoid delays and duplication of adoption process; and
(e) the remedial steps taken by the Government in this regard?

(a): At present, adoption of children is done under the Juvenile Justice (Care and Protection of Children) Act, 2015 and the Hindu Adoptions and Maintenance Act (HAMA), 1956. As per the Child Adoption Resource Information and Guidance System (CARINGS), an Online Portal, Gender-Wise details of children placed in Adoption during last three years and current year (upto 24.06.2019) are as under:

The data shows that the number of female children placed in Adoptions under the Juvenile Justice (Care and Protection of Children) Act, 2015 have been more as compared to the male children. A large number of domestic adoptions also happen under the Hindu Adoptions and Maintenance Act (HAMA), 1956; however the corresponding data on adoption is not available with the Ministry of Women and Child Development.

(b): As per details available in CARINGS, a total of 6971 Orphaned/ Abandoned/ Surrendered Children are living in 488 Specialised Adoption Agencies (Government and Non-Government). Further, a total of 1706 Children are residing in the Child Care Institutions (CCIs) linked with the SAAs in CARINGS. The State-wise details of children in the Specialised Adoption Agencies (SAAs) and Child Care Institutions (CCIs) are placed at Annexure-I & Annexure-II respectively.

(c): No Sir. All adoptions under the Juvenile Justice (Care and Protection of Children) Act, 2015 and Adoption Regulations, 2017 are being regulated by State Adoption Resource Agency (In-country Adoptions) and Central Adoption Resource Authority (Inter-country Adoptions).

(d) & (e): The entire adoption procedure has been made on-line through the Child Adoption Resource Information and Guideline System which has made the system fully transparent and accessible. The Specialised Adoption Agencies (SAAs) who are found to be not complying with the Adoption Regulations, 2017 are being issued show cause notices as per Regulation 25 (3) of Adoption Regulations, 2017 after which they are either fined or their recognition is suspended/ revoked, as per the provision of Section 65(4) of the JJ Act, 2015 and Regulation 25 of the Adoption Regulations, 2017, if they are found to be violating the provisions of the Act and/or the Regulations. Further, the Government also undertakes awareness initiatives for this purpose.
