Question : ILLEGAL MIGRANTS



(a) whether the Law Commission has made any recommendation regarding early detection and repatriation of illegal migrants in the country;

(b) if so, the details thereof;

(c) the details of the recommendations accepted by the Government; and

(d) the steps taken by the Government for the implementation of these recommendations?

(a)to(d): The Law Commission of India presented its 175th Report on Foreigners (Amendment) Bill, 2000 to the government in September, 2000. The recommendations, inter-alia, included setting up of a separate Immigration Cadre and Immigration Tribunal, appointment of Immigration Officer, establishment of Immigration Courts and enhancement of existing punishment in the Foreigners Act, 1946. The recommendations of the Law Commission were examined by the Government and it was decided to accept only one of the recommendations related to enhancement of punishment. Accordingly, necessary amendment in Foreigners Act, 1946 was notified vide Foreigners (Amendment) Act, 2004 (No.16 of 2004) on 23.2.2004.
