Question : LICENCE FOR EXPLOSIVES



(a) the terms and conditions issued by the Government for issuance of permanent licence for fireworks/explosives in the NCT of Delhi;

(b) the details of permanent fireworks licence holders in Delhi and whether they are complying with the condition laid down in their licence term;

(c) whether some of the licence holders have failed to adhere to the prescribed noise level norms for the products they sell;

(d) if so, the action taken by the Delhi Police and the Delhi Pollution Control Board against such licence holders and shopkeepers selling banned variety of crackers;

(e) whether the Government has laid down any time schedule to inspect the premises of the licence holder;

(f) if so, whether the Government has conducted any routine/surprise inspections against the shopkeepers and licence holders; and

(g) if so, the number of inspections conducted during each of the last three years and the current year and the discrepancies noticed/found during inspection alongwith the action taken against erring licence holders/shopkeepers?

(a) The licence for possession and sale of fireworks is granted by the authorities listed in Schedule IV in pursuance of Rule 155 of Explosive Rules, 1983. The terms and conditions under which such licences are granted, are in accordance with the Rule 135, 136, 137, 138 and the conditions of licence in Form-24 under Explosive Rules, 1983.

(b) to (d): The licences are granted after verifying the veracity during inspection and confirming the compliance of provisions of Explosive Rules, 1983. The details of the permanent fireworks licence holders in Delhi are given below:-

Surprise inspections are conducted by various agencies such as Delhi Police, Petroleum and explosive Safety Organisation (PESO) etc.Complaints of violation of norms have not come to the notice of Delhi Police and PESO.

(e) and (f):a special inspection drive is carried out every year for inspection of all the fireworks shops to verify safety norms adhered by licensee. Besides, inspections are also carried out by officers as authorised under sub rule (1) of rule 179 of the Explosive Rules, 1983.

(g) The details of the number of inspections conducted during each of the last three years and the current year are given in Annexure. The details of action taken by Delhi Police under IPC, Delhi Police Act, 1978 and 9 ‘b’ Explosive act against illegal fireworks/shopkeepers during the year 2005, 2006, 2007 and upto 30th September in 2008 are given below:
