Question : Quota for Divyang Students

(a) the nature of physical disabilities considered under the reservation quota for the
purpose of admission in educational institutions;
(b) whether the quota for the disabled is being filled up regularly in educational
institutions in the country;
(c) if so, the details thereof and if not, the reasons therefor;
(d) whether there is any proposal to increase the percentage of quota for the
disabled; and
(e) if so, the details thereof?

(a): The schedule of the Rights of Persons with Disabilities (RPwD) Act, 2016,
notified by the Ministry of Social Justice & Empowerment, contains the list of
specified disabilities. As per Section 32 of the RPwD Act, 2016, the persons with
benchmark disabilities i.e. disability of 40% or more, belonging to any of the specified
disabilities mentioned in the Schedule are eligible for atleast five percent reservation
in Government/ Government-aided Higher Educational Institutions.
(b) & (c): Instructions have been issued to the Higher Educational Institutions for
ensuring reservation of 5 per cent of the seats for Divyang students. The University
Grants Commission has informed that all the eligible students, under the RPwD Act,
2016, who apply for admission are given admission against the Divyang quota.
(d) & (e): The Ministry of Social Justice and Empowerment has informed that there is
no such proposal under consideration.
