Question : Crime Cases Registered under POCSO Act

(a) the total number of crime against children reported under the Protection of Children from Sexual Offences (POCSO) Act during each of the last three years and the current year, crime and State-wise;

(b) whether there is any decline in such cases after enforcement of the said Act since 2012 in the country, if so, the details thereof and the number of people tried and convicted under the said Act, crime and State-wise;

(c) the total number of such cases in the Courts and criminals punished so far under the POCSO Act, State-wise;

(d) whether the Government is aware that several NGOs have raised the issue of
rehabilitation of such victims after the trials, if so, the details thereof along with the steps taken to provide financial assistance to the minors after the conclusion of the trial; and

(e) the other measures taken to stop such cases in future?

(a) to (c): As per the information provided by National Crime Records Bureau (NCRB), State/UT-wise cases registered, persons arrested, cases chargesheeted, persons charge sheeted, cases in which trials were completed, persons whose cases trials were completed, cases convicted, persons convicted, cases pending trial at the end of the years and persons under trial under the Protection of Children from Sexual Offences Act is enclosed as Annexure-I.

(d) to (e): The Ministry of Women and Child Development is implementing a centrally sponsored scheme namely Integrated Child Protection Scheme (ICPS) under which financial assistance is provided to the State Governments/ UT Administrations for inter-alia, undertaking a situational analysis of children in difficult circumstances, for setting up and maintenance of various types of Child Care Institutions (CCIs) either directly or through NGOs.
‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India. The responsibilities to maintain law and order, protection of life and property of the citizens rest primarily with the respective State Governments. The State Governments are competent to deal with such offences under the extant provisions of laws. The Ministry of Home Affairs has issued advisories for combating crimes against children. These Advisories are available on www.mha.nic.in.
National Commission for Protection of Child Rights (NCPCR) has organized series of Training-cum-Awareness Workshops/ Programmes on Juvenile Justice Act, 2015 and the POCSO Act, 2012 to sensitize stakeholders from various departments and the NGOs. NCPCR has organized consultation on ‘Child Online Safety’ to develop a protocol for online safety of children and also developed guidelines for setting up of Child Friendly Police Stations in States to attend complaints against children in friendly and conducive atmosphere.
