Question : Crime against SC-ST-Minority Communities

(a) whether instances of discrimination and crime/atrocities against SC/ST Communities and other minorities are on the rise in the country;

(b) if so, the details thereof indicating the total number of such cases reported, cases solved/unsolved, persons arrested, action taken against the guilty and conviction rate achieved separately during each of the last three years and the current year, crime, gender and State-wise including Maharashtra;

(c) whether the Government has identified the reasons behind such increase and if so, the details thereof;

(d) whether the Government is aware that there are several cases pending in different States under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, if so, the details thereof and the reaction of the Government in this regard;

(e) Whether the Government has set up any special courts under the said Act
for speedy trial of such cases;

(f) if so, the details thereof and the total number of said courts set in the country, State-wise; and

(g) The other measures taken by the Government to check such cases and ensure the safety and security of SCs/STs and minorities including the details of advisories issued to the State Governments and Police Departments in this regard?

(a) to (c): As per the information provided by the National Crime Records Bureau (NCRB), Crime-head-wise and State/UT-wise data for Scheduled Caste and Scheduled Tribes Community during the years 2013, 2014 and 2015 is enclosed as Annexure – I, IA, II& IIA respectively.
NCRB has started collecting data gender-wise under crimes against Scheduled Castes (SCs) and Scheduled Tribes (STs) since 2014. As per available data, State/UT-wise & gender-wise such data during 2014 and 2015 is enclosed as Annexure – III. Data relating to minority is not maintained separately by NCRB.

(d): As per available information, State/UT-wise data relating to the cases pending for trial under atrocities against SCs and STs at the end of 2015 is enclosed as Annexure – IV.

For speedy trial of cases, section 14 of the PoA Act as amended provides for specification of Session Court of District as a Special Court, as well as establishment of Exclusive Special Courts.

(e) & (f): As per available information, 194 Exclusive Special Courts have been set up by fourteen States.

(g): As per the seventh schedule to the Constitution of India `Police` and `Public Order` are State subjects and, as such, the primary responsibility of prevention, detection, registration, investigation and prosecution of all crimes, within their jurisdiction, lies with the State Governments/ Union Territory Administrations. However, Ministry of Home Affairs has issued advisories which are available at www.mha.nic.in.
