Question : ILLEGAL ENCROACHMENT ON GOVERNMENT LAND



(a) whether the Hon’ble Supreme Court has given any direction for zero tolerance towards illegal constructions on encroached Government land;

(b) if so, the details thereof; and

(c) the action taken/being taken by the Government in this regard?

THE MINISTER OF STATE IN THE MINISTRY OF URBAN DEVELOPMENT (SHRI BABUL SUPRIYO)

(a) & (b): Director of Local Bodies, Govt. of NCT of Delhi (GNCTD) has informed that Hon’ble Supreme Court of India has issued several directions from time to time in SLP 8519/2006 titled as UOI Vs. state of Gujarat directing the authorities concerned to ensure zero tolerance of illegal construction on encroached Government land.

(c): The Local Bodies in Delhi are taking action against encroachment in the right of way of the road as per guidelines issued by the Government and regular inspections are made by field staff to check encroachment and quick action is taken at Zonal level with the help of Police force as and when any such encroachment is noticed.
