Question : Collection of Toll Tax

(a) the details of the criteria and guidelines to regulate the collection of toll tax on the national highways by the developers;

(b) whether the cases have been brought to the notice of Government regarding violation of the terms and conditions of tenders by the private highway developers for collecting toll tax in excess of the prescribed rates;

(c) if so, the details thereof; and

(d) the action taken by the Government in this regard?

(a) The user fee rates for fee plazas of Built, Operate and Transfer [BOT (Toll)] and Operation, Maintenance and Transfer (OMT) projects are as per applicable NH Fee Rules (1997/2008) and provisions of respective Concession Agreements. However, user fee rates of Public Funded fee plazas are as per National Highways Fee (Determination of Rates and Collection) Rules, 2008, as amended from time to time.

(b) to (d) Any case of irregularity/overcharging is dealt with on case to case basis as per the provisions of respective Contract/Concession Agreement.
