Question : Protection of Good Samaritans

(a) whether it is fact that people do not come forward to help a road accident victim due to fear of unnecessary legal hassles and if so, the reaction of the Government thereto;
(b) whether the Government has introduced any rules and guidelines for protection of Good Samaritans and if so, the details thereof;
(c) whether several Government and private hospitals have neither displayed any charter specifying these rules at their entry points nor published these rules on their website in Hindi, English and other regional language;
(d) if so, the reaction of the Government thereto; and
(e) the details of the programmes being run by the Government to sensitize the people about the rights of Good Samaritans?

(a) The Ministry has inserted Section 134-A in the Motor Vehicles (Amendement) Act, 2019 for the protection of Good Samaritans who come forward to help a road accident victim.

(b) The Ministry has issued the Rules for the protection of Good Samaritans vide Notification dated 29th September, 2020.

(c) & (d) The Ministry has no such data. However these rules are available on Ministry’s website.

(e) Ministry of Road Transport & Highways implements a scheme for undertaking publicity measures and awareness campaigns on road safety issues to create awareness among road users through the electronic media, print media, NGOs etc. Ministry has notified “Member of Parliaments’ Road Safety Committee” in each district of the country to promote awareness amongst road users under the chairmanship of Hon’ble Member of Parliament (Lok Sabha) from the district. Ministry has given awards to Good Samaritans during the Road Safety Month this year.
