Question : PENSION TO HIV INFECTED JAWANS



(a) whether HIV infected constables in BSF are entitled for invalid pension inspite of rendering 10 years complete service;

(b) if so, the number of constables accorded such pension benefits;

(c) whether such pension benefits are applicable in case of Jawans in other services also; and

(d) if so, the details thereof?

(a): Yes, Sir. In terms of rule 38 of Central Civil Services (Pension) Rules, `invalid pension` is admissible to a government servant retiring from service on account of any bodily or mental infirmity, which permanently incapacitates his for the service.

(b),(c)&(d): The invalid pension is admissible to the Jawans of other para military forces as well. In Assam Rifles, 20 HIV infected persons have been granted pension since 1997 till date.
