Question : Punishment for Rapists

(a) whether the Judiciary in its latest verdict has recommended castration as a form of punishment to the rapists who have been found guilty;

(b) if so, the details thereof and the reaction of the Government thereto;

(c) whether the Government proposes to amend the Indian Penal Code based on the suggestions made by the learned judges and if so, the details thereof;

(d) whether the Government has any proposal to make amendments in the penal law to introduce separate punishment for each crime instead of the commutation of sentence of those who commits crime again and again; and

(e) if so, the details thereof and if not, the reasons therefor?

(a) to (e) : ‘Police’ and ‘Public Order’ are State subjects under the Seventh Schedule to the Constitution of India. The responsibilities to maintain law and order, protection of life and property of the citizens are with the respective State Governments. The punishment in rape cases are awarded as per the provisions contained in extant laws. Amendment to the laws is a continuous process, and is undertaken after due consultations
