Question : Violation of Guidelines by Airlines

(a) whether certain airlines are reportedly not following the guidelines stipulated by the Government during issuance of license;

(b) if so, whether these airlines have not complied to such guidelines despite issuance of warning by the Government;

(c) if so, the details thereof;

(d) the details of action taken including conducting of surprise checks by the Government in this regard; and

(e) whether there is any provision to impose penalty for violation of such guidelines and if so, the details thereof?

(a) to (c): The Air operators Permit (Licence) to the airlines is issued after ensuring the compliance of all regulatory requirements following a comprehensive procedure as laid down under Air Operators Certification Manual-CAP 3100. During the certification process aspects like organisation structure, operational procedures, capability of airlines operator for operation & maintenance are checked and verified and all airlines are subjected to continuous oversight and surveillance to ensure that they continue to comply with relevant regulatory provisions.;

(d): The details of surveillance/inspection carried out during the last 3 years for scheduled airlines are given below:;

Corrective action for non-compliance in the form of issuance of warning, suspension of license etc. were taken as per the level of non-compliances..; (e): Rule 161 and Schedule VI of the Aircraft Rules, 1937 provides for the penal provisions for violation of regulatory requirements as laid down under the Aircraft Rules 1937 or any relevant Civil Aviation
Requirements.
