Question : Disrespect to National Anthem and Flag

(a) whether incidents of disrespect to the National Flag and the National Anthem are increasing in the country;

(b) if so, whether the Government has taken a serious view in this regard;

(c) if so, the details thereof along with the details of such incidents reported during the last one year and the current year, State-wise;

(d) whether the Government has issued any guidelines and directions to all the States in this regard;

(e) if so, the details thereof along with the assurance received from the States, including J&K; and

(f) the other steps taken by the Government in this regard?

(a) to (f): Complaints relating to the incidents of the disrespect of National Flag and National Anthem are received in the Ministry of Home Affairs. Since the offence of disrespect of National Flag and National Anthem is punishable under section 2 and section 3 of the Prevention of Insults to National Honour Act, 1971, these complaints

are forwarded to the concerned State/Union Territory Government for taking action as per law, as the onus of implementation of the said Act lies with authorities under whose jurisdiction the alleged act of disrespect has taken place. State/Union Territory-wise details of these complaints are not maintained in the Ministry of Home Affairs. The Ministry of Home Affairs however, has been issuing advisories, from time to time, to all State/Union territory Governments to strictly comply with the provisions of the Prevention of Insults to National Honour Act, 1971.
