Question : ALLOTMENT OF TENEMENTS IN REHABILITATION COLONIES



(a) whether slum dwellers in UT Chandigarh enrolled as voters as on December 8, 1996 are entitled to allotment of tenements in rehabilitation colonies;

(b) if so, the details thereof;

(c) whether demolitions were carried out recently without relocating the eligible persons;

(d) if so, whether conditions for rehabilitation under the relevant scheme were changed some time back;

(e) if so, the details thereof and the reasons therefor;

(f) whether the condition relating to enrolment in the voters` lists only has deprived a number of slum dwellers settled in Chandigarh since very long of the right to seek allotment of a tenement under the Scheme;

(g) if so, the facts thereof;

(h) whether there have been complaints that in many cases names were deleted from the voters` lists though the concerned persons were given enumeration slips and had been voters many years before that date; and

(i) if so, the details of system, if any, to redress such grievances?

(a)&(b): According to information received from the Union Territory of Chandigarh Administration, as per rehabilitation Scheme, 1979 as amended from time to time, the slum dwellers who were enrolled as voters as on 8.12.1996 were/are eligible for the allotment to tenements. Survey/verification as to their eligibilities is conducted as and when such people are uprooted and rehabilitated and allotted site/tenements as and when available for allotment.

(c): No, Sir.

(d): Minor changes have been made in the schemes from time to time.

(e): 1. Income criteria of the slum dweller has been deleted by the Chandigarh Administration vide Notification dated 9.12.1997.

2. The cut off date has been changed from time to time and now the cut off date is 8.12.1996 as per Notification dated 22.6.1998.

3. These changes were made in order to ensure that the benefit of rehabilitation may reach to the genuine and needy persons only living in labour colonies.

(f)&(g): The migrants whose name did not exist in the voter list as required as per the rehabilitation scheme were not entitled to the allotment of tenements/sites.

(h): No written complaint has been received as reported by the Election Department.


(i): If any person does not find his/her name registered in the electoral rolls, such person can file a claim for enrolment under Section 23 of the Rehabilitation of People Act, 1950.
