Question : Swachh Bharat Kosh under CSR

(a) whether the Government has any plan to give leverages for donations in Swachh Bharat Kosh under Corporate Social Responsibility (CSR) funding and if so, the details thereof;

(b) if not, the reasons therefor; and

(c) the extent to which this initiative will help to boost in the funding of aforesaid Kosh along with the legal, financial and administrative implications?

(a) to (c) : Contribution to ‘Swachh Bharat Kosh’ is included as a Corporate Social Responsibility (CSR) activity under Schedule VII of the Companies Act, 2013 (the ‘Act’). As per section 135 (3) & (4) of the Act, the Board of the CSR eligible company, and its CSR Committee, are empowered to take decision on the CSR programmes / projects / activities to be undertaken including the area where the works are to be undertaken under such programmes/projects. There is no proposal for changing any provision of the Act or the Rules thereunder for contributions made in ‘Swachh Bharat Kosh’. The total contribution to ‘Swachh Bharat Kosh’ as part of CSR expenditure as reported by the companies for the years 2014-15 and 2015-16, as per the filings made on MCA21 registry upto 31.03.2017, is Rs. 94.57 crore and Rs. 321.03 crore respectively.
