Question : Illegal Drug License and Health Centres-Clinics

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether attention of the Government has been drawn towards reported instances of prevalence of fake drug license in various States/UTs;

(b) if so, the details thereof indicating the number of such cases reported and the action taken by the Government against the offenders during the last three years and the current year, State/UT-wise;

(c) the steps taken/proposed to be taken by the Government for periodic review of the policy governing issue of drug license and defection of fake licences them; and

(d) the actions taken/proposed to be taken by the Government against the illegal health centres/clinics during the said period, State/UT-wise indicating the rules formulated therefor?

(a) & (b): A few instances where licenses had been issued without jurisdiction by State Licensing Authorities have come to the notice of the Central Government recently. The State Licensing Authorities have, in such cases, been directed to cancel such licenses.

(c): Issues relating to the practices followed for issuances of licenses, enforcement, etc., are considered regularly in the meetings of the Drug Consultative Committee (DCC) and the DCC makes suitable recommendations to the Government. The Government has also approved a proposal to strengthen the drug regulatory structures at a total cost of Rs.1750/- crore to be spent over next three years. This includes organization wide e-Governance. In the networked environment, the entire information will be available online and necessary corrective measures can be taken.

(d): Health is a State subject. The Central Government has enacted the Clinical Establishments (Registration and Regulation) Act, 2010 and made rules thereunder. Action can be taken by the State Governments, where the Act has been adopted. However, the Act has been adopted only in 9 States and Union Territories (except Delhi).
