Question : ACCIDENTS IN COAL MINES



(a)the number and nature of accidents that have occurred in various coal mines of Jharkhand during the last three years and the current year;

(b)the number of persons injured/ killed in those accidents during the said period, year- wise;

(c))whether any investigation has been carried out to identify the causes of those accidents and whether any action has been taken against the officials responsible therefor;

(d)if so, the details thereof and the number of persons found guilty in this regard and the action taken/ proposed to be taken by the Government against them the steps taken by the Government for relief, rehabilitation and welfare of the injured / deceased workers and their families, subsidiary-wise; and

(e)the corrective measures taken/ being taken by the Government to improve the safety of workers in coal mines of Jharkhand?

(a)&(b): The subsidiary company-wise number of fatal accidents, fatalities, serious accidents and serious injuries during the last three years from 2011 to 2013 and the current year 2014 (upto June) in Jharkhand are given below:

(c)&(d): Investigations/inquiries of fatal accidents have been conducted in different subsidiary of Coal India Ltd (C1L) in the state of Jharkhand`to find out the causes and circumstances leading to those fatal accidents and also to fix responsibility of the persons for those fatal accidents. The law enforcing agency / regulatory authority under the Mines Act- 1952 i.e. the Director General of Mine safety (DGMS) under the aegis of Ministry of Labour & Employment (MOLH) also conducted the statutory enquiry / investigation to find out the causes and circumstances leading lo such mine accidents as per the provisions, made under the Mines Act-1952. Further to statutory inquiry done by DGMS, all mine accidents are also inquired / investigated by the Mine Manager or any Asst Manager authorized by the Mine Manager and the Safety Officer of the respective mine as per provisions made under the Coal Mine Regulation- 1957.
Apart from the above investigations / enquiries made under various provisions of statutes, the Internal Safety Organization (ISO) of each subsidiary company has also conducted enquiry in case of any fatal accident. Appropriate actions have been taken or initiated or under process against those persons who arc held responsible in ISO inquiries on the basis of finding of the ISO enquiries after due review and obtaining required approval of the competent authority. Details of number of persons held responsible in ISO enquiries along with the action taken are given below.

Regarding persons held responsible in the DGMS statutory inquiries, appropriate punitive actions are taken or initialed against such persons as per provisions made under the Mines Act-1952. Details of such statutory inquiries and action taken thereof are only available with the DGMS.

(e): The subsidiaries of CIL provide the following for relief, rehabilitation and welfare etc. to the family of the deceased who died in any mine accident arising out of and in course of employment.
Payment of compensation under Employee`s Compensation Act — 2009. Employment is offered to the eligible kin of the deceased. In case there is no eligible person for employment, monetary compensation per month is paid to the family of the deceased.
Special Relief package of Rs. 5 Lakhs, which is in addition to the amount payable under Workmen Compensation Act-1923 for departmental employee.
Immediate lump sum payment for the funeral expenses to the family of deceased. Monetary benefits under the Life Cover Scheme (LCS) of Rs 1,12, 800 w.e.f 01.02.2012 as per NCWA-IX. Ex-gratia amount of Rs 84,600 in case of the death or permanent total disablement resulting on account of accident arising out of and in course of employment w.e.f. 01.02.2012 as per NCWA-IX. Gratuity on the basis of the length of service, P.F as per CMPF rule, encashment of EL and Payment of Pension as per CMPS, 1998 are paid in addition to the above compensations.

Total amount of compensation paid to the next of kin of the deceased as per the Employee Compensation Act -2009 for the last three years and the current year in different subsidiaries of CIL in Jharkhand are given below:

(f): Apart from complying the statutory safety provisions as laid down in the Mines Act, 1952 and the Coal Mine Regulations- 1957 and Byelaws & Standing Order framed there under, the following corrective measures have been taken / are taken by the subsidiaries of CIL located in Jharkhand State to improve standard of safety. The?,e are as under:
1.A structured multi-disciplinary Internal Safety Organization (ISO) to assist the line management at various levels in matters related to safety has been established.
2.Risk Assessment & Safety Management Plan: Risk assessment based Safety Management Plans have been prepared for all mines. It is an on-going process for continuous improvement of safety standards in mines.
3.Safety Audit of the mines is being conducted from time to time. Steps for Disaster Prevention:
4.Measures to check Inundation/ in rush water.
5.Measures for reduction of rooi7side falls accident.
6.Measures for reduction of accident at Opencast as well as on surface of mine.
8. Special Safety Drives are conducted periodically to assess the level of compliance of safety norms in each mine. Annual safety fortnight is also conducted once every year for the same purpose.
