Question : RESERVATION FOR JAT COMMUNITY



(a) whether the Supreme Court has scrapped reservation provision for Jat community;

(b) if so, the details thereof and the reasons therefor;

(c) whether the Union Government has received any representation from the community to revoke the order; and

(d) if so, the details thereof and the action taken in this regard?

(a): Yes Madam,

(b): “Jat” community was included in the Central List of OBCs of OBCs for 9 States/Union Territories vide Notification No. 20012/129/2009-BC.II dated 04/03/2014. The said Notification was challenged in the Hon’ble Supreme Court by way of W.P. No. 274 of 2014 filed by Ram Singh and Ors Vs Union of India and a batch of other writ petitions . The Hon’ble Supreme Court has disposed of these petitions vide Order dated 17.03.2015 by concluding that “…Accordingly the aforesaid Notification bearing No. 63 dated 04.03.2014 including the Jats in the Central List of OBC for the States of Bihar, Gujarat, Haryana, Himachal Pradesh, Madhya Pradesh, NCT of Delhi, Bharatpur and Dholpur Districts of Rajasthan, Uttar Pradesh and Uttrakhand is set aside and quashed. The writ petitions are accordingly allowed”.

(c) & (d): Yes. The Union Government has received many representations from various individuals/ organisations to revoke the order. The Union Government has filed a review petition against the Hon’ble Supreme Court order dated 17.03.2015.
