Question : Right to Education

(a) whether the Government has asked the State Governments of Goa, Manipur, Mizoram,
Sikkim and Telangana to issue notifications regarding the admissions under the Right of
Children to Free and Compulsory Education (RTE) Act, 2009;
(b) if so, the details thereof including the dates on which such recommendations were conveyed;
(c) whether the Union Government has asked State Governments which have not notified the
per child cost under the RTE, to notify the same;
(d) if so, the details thereof including the dates on which such recommendations were conveyed;
(e) whether the Government has undertaken a review of the working of the RTE, to ascertain as
to why only a fraction of the amounts sought by the States from the Government, were actually
reimbursed; and
(f) if so, the details thereof and if not, the reasons therefor?

(a) to (d): 33 States and UTs have already notified disadvantaged groups and weaker sections
which are eligible for admission in Private unaided Schools under Section 12 (1) (c). Telangana
is the only State which is yet to notify Disadvantaged groups and Weaker Sections. Besides this,
15 States and UTs have notified Per Child Cost for reimbursement to private unaided schools
against admission of children belonging to disadvantaged groups and weaker sections under
Section 12(1)(c). The reimbursement from Central Government to States and UTs has started
from 2014-15 onwards.
Ministry of Human Resource Development (MHRD) vide letter no 12-5/2016-EE.11 dated
25.05.2016 requested States and UTs to carry out a ground assessment of private unaided schools
across the country to ensure compliance with provisions of Section 12 (1)(c) of RTE Act, 2009.
Further, MHRD, in various meetings like State Education Secretaries conference, Project
Approval Board Meetings, Regional Workshops, reviews and emphasis on the proper
implementation of the provisions of RTE Act.
(e)&(f): The RTE Act under Section 12 (2) also makes provision of reimbursement of
expenditure to schools providing free and compulsory elementary education as specified in
clause (c) of sub-section (l) of Section 12. The school shall be reimbursed expenditure so
incurred by it to the extent of per-child-expenditure incurred by the State, or the actual amount
charged from the child; whichever is less, in such manner as may be prescribed. Samagra
Shiksha an Integrated Scheme for School Education has been launched by Government of India
from 2018-19, by subsuming the three erstwhile Centrally Sponsored Schemes of Sarva Shiksha
Abhiyan (SSA), Rashtriya Madhyamik Shiksha Abhiyan (RMSA) and Teacher Education (TE).
The scheme provides for support to the States and UTs for implementation of the RTE Act,
including reimbursement of expenditure incurred by them for class I to VIII.
