Question : OVERSTAY OF FOREIGNERS



(a) whether a large number of foreigners are found to have been overstaying in the country;

(b) if so, the number of foreigners who visited the country and have been found to be overstaying during each of the last three years and the current year, country-wise;

(c) the mechanism put in place to monitor the stay of foreigners in the country; and

(d) the measures taken by the Government to repatriate/deport the overstaying foreigners along with the number of foreigners deported during the said period, country-wise?

(a) & (b): As per available information, a number of foreign nationals were found to be overstaying after coming to India on valid travel documents. Country-wise details of such foreign nationals found to be overs- taying during 2011, 2012 and 2013 are given in Annexure-1.

(c) & (d): Central Government is vested with powers to deport a foreign national under section 3(2)(c) of the Foreigners Act, 1946. The powers to identify and deport illegally staying foreign nationals have also been de- legated to the State Governments/ UT Adminis- trations. Detection and deportation of such illegal immigrants is a continuous process. A revised procedure for detection and depor- tation of illegal Bangladeshi immigrants was communicated to the State Governments/ Union Territory Administrations in November, 2009, which was partially modified in February, 2011. The procedure includes sending back then and there, the illegal immigrants who are inter- cepted at the border while entering India unau- thorisedely. Country-wise details of foreign nationals repatriated/deported during the said period are given in Annexure-2.
