Question : Cancellation of Licences under FCRA

(a) whether the Government has withdrawn foreign contribution licences of a large number organizations and if so, the details thereof;

(b) the number of such licences cancelled/withdrawn as on 1st January 2022;

(c) the criteria laid down for renewal of such licences;

(d) whether the Government proposes to extend the validity of the Foreign Contribution (Regulation) Act (FCRA) registration certificates of NGOs up to March 31st, 2022 or till the date of disposal of their renewal applications in respect of entities that fulfil certain laid down criteria; and

(e) if so, the details thereof?

(a) and (b): Section 14 of the Foreign Contribution (Regulation) Act, 2010 (FCRA, 2010) provides for cancellation of certificate of registration. A total of 1811 certificates have been cancelled during preceeding three years (2019, 2020, 2021).

(c): The applications for renewal of certificate of registration issued under the FCRA, 2010 are processed in accordance with the provisions of the FCRA, 2010 and rules made thereunder.

(d) and (e): The Government vide Public Notice No. II/21022/23(22)/2020-FCRA-III Dated 31st December, 2021 has extended validity of FCRA registration certificates upto 31st March, 2022 or till the date of disposal of the renewal application, whichever is earlier, of only those entities who fulfil the following criteria:

(i) FCRA registration certificates of such entities is expiring between the period 29th September, 2020 and 31st March, 2022; and

(ii) Such entities have applied/apply for renewal on FCRA portal before expiry of certificate of registration in accordance with rule 12 of the Foreign Contribution (Regulation) Rules, 2011.

Decision on such extension of validity is taken based on assessment of situation and feedback of stakeholders.
