Question : PUNJAB TERMINATION OF AGREEMENTS ACT



(a) the details of the agreements between State Governments for sharing water of Ravi and Beas river;

(b) if so, whether Punjab Government has cance- lled the said agreement by passing the Punjab Termination of Agreements Act, 2004 (PTAA);

(c) if so, the details of the directives issued by the Union Government to Punjab Government/ Bhakra Beas Management Board (BBMB) to provide 0.60 MAF water to Rajasthan; and

(d) the action taken thereon?

(a) An agreement was signed by the Chief Ministers of Punjab, Haryana and Rajasthan on 31.12.1981 regarding reallocation of the mean supply of 17.17 Million Acre Feet (MAF) of surplus Ravi- Beas waters as given below:

(b) Punjab on 12.07.04 enacted the Punjab Termi- nation of Agreements Act, 2004 terminating all agreements relating to the Ravi-Beas Waters, including the agreement dated 31.12.1981. The Act however provides that all existing and actual utilizations through the existing systems shall remain protected and unaffected.

(c) & (d) A Presidential Reference has been made to the Hon’ble Supreme Court of India on 22.07.2004 regarding the validity of the Act. The matter is subjudice.
