Question : MARRIAGE LAWS AND DIVORCE CASES



(a) the number of divorce cases registered/disposed of in various courts in the country during each of the last three years, Court-wise;

(b) whether the Government is taking adequate steps to expedite the disposal of divorce cases including setting up of special Courts in this regard and if so, the details thereof;

(c) whether the Government proposes to amend the Hindu Marriage Act, 1955 and the Special Marriage Act, 1954; and

(d) if so, the details and the present status thereof?

(a) to (d) A statement is laid on the Table of the House.

Statement referred to in reply to parts (a), (b), (c) and (d) of the Lok Sabha Starred Question No.228 for answer on 12.03.2015.

With regard to part (a) of the question, the Government does not maintain any information on the number of divorce cases registered/disposed of by various courts in the country. However, the number of cases disposed of in Family Courts during each of the last three years and pending is placed at Annexure-I.

With regard to part (b) of the question, it may be mentioned that the disposal of divorce cases are within the domain of judiciary. The Family Courts Act, 1984 (66 of 1984) provides for establishment of Family Courts by the State Governments in consultation with the High courts with a view to promote conciliation and secure speedy settlement of disputes relating to marriage and family affairs and for matters connected therewith.

With regard to parts (c) and (d) of the Question, at present there is no proposal under consideration tofurther amend the Hindu Marriage Act, 1955 (25 of 1955) and the Special Marriage Act, 1954 (43 of 1954).
