Question : Compensation for Victims of Sexual Crimes


(a) whether the Government has formulated/created any compensation fund for the children who are victims of sexual crimes;
(b) if so, the details thereof along with the total amount granted under such fund during the current year and under which scheme the money for this fund is being utilized;
(c) if not, the reasons therefor; and
(d) whether the Government has any plan of action towards creating such a fund and if so, the details thereof?

(a) to (d): Hon’ble Supreme Court in W.P. (C) No. 565/2012- Nipun Saxena vs. UOI, vide its order dated 11.05.2018 directed all the State Governments and Union Territory Administration to implement the scheme prepared by the NALSA, in which the provisions for compensation to victims of sexual assault has been enhanced in different conditions. All the States/UTs were informed that NALSA’s Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes-2018 shall function as a guideline to the Special Court for the award of compensation to the victims of Child Sexual Offences under Section 33(8) of POCSO Act, 2012 and Rule 7 of POCSO Rules until the Rules in this regard are finalized by the Central Government. All the States/Union Territories have notified the victim compensation scheme in their respective State/UT. Under the Central Victim Compensation Fund (CVCF) scheme of Ministry of Home Affairs, financial assistance of Rs. 200.00 crores as one time grant was released to all the States/UTs in 2016-17 to support their respective State Victim Compensation Scheme.
