(a) to (d): Ministry of Home Affairs is aware of some media reports citing a
United Nations report which has estimated that there has been a rise of 30% in
domestic violence in India since 2005. However, the available information/data
on cases registered, cases, charge-sheeted, cases convicted, persons arrested,
persons charge-sheeted and persons convicted under Domestic Violence during
2005-2010 State/UT wise is enclosed at Annexure-I.
As per the information provided by National Crime Records Bureau, NCRB does
not maintain the list of persons who have lost their lives in domestic violence.
As per Seventh Schedule, âPoliceâ and âPublic Orderâ are the State subjects under
the Constitution, and as such the primary responsibility of prevention detection,
registration, investigation and prosecution of crimes, including crimes against
women pertaining to domestic violence, lies with the State Governments/Union
Territory Administrations. However, the Union Government attaches highest
importance to the matter of prevention of crimes against women and in this
regard, a detailed advisory dated 4th September, 2009 has been sent to all
State Governments/Union Territory Administrations wherein all States/UTs have
been advised to make a comprehensive review of the effectiveness of the machinery
in tackling the problem of violence against women and to take appropriate measures
aimed at increasing the responsiveness of the law and order machinery. The advisory
has specifically advised the State Governments/UT Administrations to explore the
possibility of associating NGOs working in the area of combating crimes against
women and also advises that all Police stations may be advised to display the
name and other details of Protection Officers of the area appointed under the
Domestic Violence Act, 2005.
