Question : Failure to Register FIR by Police Personnel


(a) whether First Investigation Reports (FIRs) of cognizable offence are not being lodged in the country due to the pressure from police duty officer and higher officials and the affected family is unable to get justice;

(b) if so, the reaction of the Government in this regard;

(c) the number of police personnel against whom action has been taken for not lodging FIRs of cognizable offence in the country during the last three years, State and year-wise;

(d) the provision for other alternatives made by the Government in case FIRs of cognizance offence are not lodged so that the said FIRs are lodged immediately; and

(e) the reaction of the Government on the compliance of the said alternatives?

(a) to (e): ‘Police’ and ‘Public Order’ is State subject as per the Seventh Schedule of the Constitution of India. Specific data in respect of number of police personnel against whom action has been taken for not lodging FIR of cognizable offence in the country is not maintained centrally.
