Question : Rehabilitation Council of India Act

(a) Whether the Government has fixed any minimum standards for education under the Rehabilitation Council of India Act;

(b) if so, the details thereof in respect of State of Jharkhand;

(c) whether the Government proposes to make any efforts aimed at amending minimum standards for education in Jharkhand for further strengthening of the education system in the State under the above Act; and

(d) if so, the details thereof?

(a-b) As per the Section 18 of Rehabilitation Council of India (RCI) Act, 1992, the Council may prescribe the minimum standards of education required for granting recognized rehabilitation qualification by Universities or Institutions in India.

Accordingly, RCI has prescribed 50% marks for admission to all courses from certificate to master level programmes with relaxation and reservation as per rules of respective Governments including State of Jharkhand except for M. Phil (Rehabilitation Psychology), M. Phil (Clinical Psychology), Professional Diploma in Clinical Psychology and Ph. D (Clinical Psychology), where minimum 55% marks have been prescribed relaxation and reservation as per rules of respective Governments including State of Jharkhand.

Whereas, Government of Jharkhand vide Notification No.-8/N.1-04/2011-1632 dated 05.09.2012 provides 5% relaxation in minimum qualifying marks for candidates belonging to Schedule Caste (SC), Schedule Tribes (ST) and Persons with Disabilities (PwDs).

(c-d) No such proposal is being considered by this Department, as Education is primarily a State subject and relaxation to the minimum qualifying marks falls under the purview of the respective State Governments.
