Question : PERMISSION FOR CONDUCTING INVESTIGATION



(a) whether the requirement seeking permission from the Government before conducting any inquiry against the officers involved in irregular activities restricts investigations;

(b) if so, the reaction of the Government thereto; and

(c) the details of officers for which Investigating Agencies sought permission for conducting inquiry during the last two years and the current year?

(a) & (b): The requirement seeking permission from the Government before conducting any inquiry/investigation against the officers for Prevention of Corruption Act (PC Act) cases under Section 6A of the DSPE Act 1946 has been done away with by the Hon’ble Supreme Court in its judgement dated 06.05.2014.

(c): No centralized data is maintained or available in this regard. Insofar as the CBI is concerned, before the requirement of seeking permission for conducting inquiry/investigation was done away with by the above mentioned order of the Hon’ble Supreme Court, it had sought permissions in 95 cases under Section 6A of DSPE Act against the officers of Joint Secretary level and above during the last two years and up to May of the current year.
