Question : Compensation to Displaced Families

(a) whether a number of displaced families have raised the issue of not being given any compensation or rehabilitation facillities;
(b) if so, the details thereof;
(c) the total amount of expenditure incurred by Coal India Limited(CIL) and its ancilliary companies as compensation for displaced families during the last three years and the current year, State-wise;
(d) whether the Government has made any assessment about the losses suffered by coal mines due to protests by the displaced families;
(e) if so, the details thereof; and
(f) the details of number of criminal cases filed against such protestors during the said period?

(a) & (b): While CIL & its subsidiary companies have always made all efforts to pay compensation & benefits as per the provisions of relevant Acts and statutes prior to possession of land from Project Affected Families/Project Affected People(PAFs/PAPs) however, sometimes due to demands that are beyond norms, payments remain disputed/delayed. In case of any dispute, the payments are deposited with the Tribunal constituted under the Act. In case of payment of compensation, the following disputes are generally faced:

• Dispute amongst family members regarding the share of compensation.
• Tenants demanding land compensation multiple times than the norms.
• Tenants refusing to accept compensation demanding new rates for old acquisitions.
• Unwillingness of land losers to part with the partially acquired land under their possession and demanding acquisition of the balance land too.

In case of R&R, the disputes are complex in nature and usually involve issues that are beyond the control of CIL & its subsidiaries. Effective modalities and mechanisms like District R&R Committee are already in place to ensure fairness in benefits to PAFs/PAPs. However, due to the following reasons the R&R is delayed:

• Delay in R&R due to inability of State Government to provide suitable R&R site.
• Resistance of native/original residents of identified R&R site to R&R of targeted villages.
• Refusal/resistance of PAFs to shift to the rehabilitation site provided by the State Government.
• Demand from PAFs/PAPs for benefits such as rate of house plots as per new R&R Policy against old acquisitions.

(c): The total amount of expenditure incurred by Coal India Limited (CIL) and its ancillary companies as compensation for displaced families during the last three years and the current year, state-wise is as under:-
