Question : AMENDMENT IN EXPLOSIVE RULES, 1983



(a) whether licences granted by District Authorities under the provision of Explosives Rules, 1983 are limited for specific jobs;

(b) if so, whether small quarry holders from all over the country have to get the permission from Deputy Chief Controller of Explosives, Agra for possession of Explosives for mining purposes;

(c) if so, whether these small quarry holders are facing lot of difficulties in obtaining the licences from Deputy Chief Controller of Explosives, Agra each and every time;

(d) if so, whether the Government have received any proposals from several State Governments including Rajasthan for amendment in certain rules of Explosives Rules, 1983 facilitating blasting in small Mines and Stone Quarries;

(e) if so, the details thereof; and

(f) the reaction of the Government thereto ?

(a) Yes, Sir. District Authorities can issue licences in Form 23 for specific jobs as enumerated in Schedule IV of the Explosives Rules, 1983.


(b) Small quarry owners have to obtain a licence in Form 22 of Explosives Rules, 1983 for possession and use of explosives for mining purposes from the concerned Circle Office of the Department of Explosives in whose jurisdiction the quarry is located. The Jt. Chief Controller of Explosives, Agra has jurisdiction over the States of Uttar Pradesh and Madhya Pradesh.

(c) No, Sir. For grant of licences, procedures as laid down under Rule 154(4) of the Explosives Rules, 1983 have to be followed and required documents including a `No Objection Certificate` from the District Magistrate have to be furnished for obtaining a licence in Form 22 for possession and use of explosives. If all the documents are in order, a licence is granted and sent for inspection and endorsement to the concerned Sub-Circle Office. The licence comes into force after endorsement by the Inspecting Officer.
