Question : AGREEMENT WITH WORKMEN`S ORGANIZATIONS

:

(a) whether it is a fact that the Government in a tri-partite meeting held on 1st August,2002 entered into an agreement with the workmen’s organizations to address their demands in a time bound manner;

(b) if so, the facts and details thereof; and

(c) the progress made so far in this regard ?

THE MINISTER OF COAL (SHRI KARIYA MUNDA)

(a) & (b): Yes, Sir. A Memorandum of Settlement was arrived at between the management of Coal India Limited(CIL) and its workmen represented by the five Federations of Trade Unions affiliated to Indian National Trade Union Congress(INTUC), Bharatiya Mazdoor Sangh (BMS), All India Trade Union Congress(AITUC), Centre for Indian Trade Unions (CITU) and Hind Mazdoor Sabha (HMS) on the industrial dispute over strike notice dated 17-7-2002 before the Chief Labour Commissioner (Centrl) on 1.8.2002.

The details of the above Memorandum of Settlement (MOS) are as follows:-

1. The unions were assured that the Group of Ministers (GOM) on Coal Industry will hear the 5 Federations of unions, namely, Indian National Mine Waorkers Federation (INTUC), Indian Mine Workers Federation (AITUC), Akhil Bhartiya Khadan Mazdoor Sangh (BMS), All India Coal Workers Federation (CITU) and Hind Khadan Mazdoor Federation(HMS). Till such time, the matter of amendment of Coal Mines Nationalization (Amendment) Bill, will not be moved for consideration in Parliament. Independently, within a month, the unions will also have discussions with the Coal Ministry with a view to resolving the issue.

2. It is agreed that the revival plan of Eastern Coalfields Limited (ECL), Bharat Coking Coal Limited(BCCL), Central Coalfields Limited (CCL) and North Eastern Coalfields Ltd., (NEC) within one month along with the unitary plan and the revival plan will be finalized.

3. It is agreed that the 5 Federations of trade unions operating in Coal industry may submit the revival plan for Dankuni Coal Complex (DCC) which will be jointly discussed by CIL management till this discussion takes place, further action on tendering will be kept in abeyance.

4. There is no proposal either for disinvestments or privatization of Coal India or any of its Subsidiary companies.

5. Joint discussions will be held by the trade unions with the Government on the following issues within 3 months: -

i)	Income tax on fringe benefits;
ii) Rate of interest on Coal Mines Provident Fund;
iii) Pension


6. Pending issues to be discussed with Coal India Management:

It is agreed that in regard to the demands raised in the 21 Point Charter of Demands which are related to Coal Industry, will be settled through the joint discussions between the Management and the trade unions by the end of December,2002.

7. Re-Constitution of JBCCI-VII

It has been agreed to constitute joint Bi-Partite Committee for Coal Industry-VII (JBCCI-VII), with a view to start immediate wage negotiations after submission of charter of demands by the trade unions.

8.The parties should submit implementation report by 31st March,2003. If no report is received by that time, the Settlement shall be deemed to be implemented.

(c): The progress made so far in this regard :

1. The matter has been discussed with the unions in the Coal Ministry. A note containing the demand and supply scenario of coal is being submitted to the unions for further discussions.

2&3. The revival plans of ECL,BCCL &CCL including DCC have been discussed with the unions from time to time. In the meantime, further action on tendering of DCC has been kept in abeyance.

4. Noted by the unions.

5. These discussions will be held with the Ministry of Finance and Ministry of Labour.

6. Pending issues have been discussed with the unions in different Committees.

7. A decision on the constitution of JBCCI-VII is being taken by the Ministry of Coal.
