Question : USE OF THE EMBLEMS AND NAMES



(a) whether the Emblems and Names (Prevention of Improper Us

(e), Act 1950 prohibits the use of name which may suggest patronage of Central/State Governments by the trading, commercial and professional organisations without permission of the Government;

(b) if so, whether provisions of the Act are also applicable to organisations instituted on non-profit basis and if so, the details thereof;

(c) the number of organisations using such names and emblems with the approval of the Union and State Governments along with the criteria adopted for the said approval; and

(d) the number of organisations found using the names and emblems illegally along with the action taken against them during each of the last three years, year and State-wise ?

(a) & (b) : Yes Madam. Under Section 3 of the Emblems & Names (Prevention of Improper Use) Act, 1950, no person can use for the purpose of any trade, business, calling or profession, or in the title of any patent, or in any trade mark or design, any name which may suggest the patronage of the Government of India, or the Government of a State or connection with any local authority or any corporation or body constituted by the Government under any law.

(c) & (d) : Since the registration of names is done by Registrar of societies of various States/UTs, no such information is centrally maintained. As and when this Department receives specific complaints, the Registrar of Societies of that concerned States/UTs are advised to take suitable action including cancellation of registration of names.
