Question : FUNCTIONING OF NGOS



(a) the total number of NGOs registered under the Foreign Contributions Regulations Act (FCRA) along with the total funds received from abroad by such NGOs during each of the last three years and the current year, country and Statewise;

(b) whether the Government has received complaints with regard to misutilisation of the foreign funds or utilisation of such funds for anti-national activities by NGOs and alleged link with extremists;

(c) if so, the details thereof and the action taken against such NGOs during the said period, NGOs and State-wise;

(d) whether there are reports that a large number of NGOs have not filed annual returns;

(e) if so, the details thereof indicating the total number of NGOs which have not filed their annual returns and the action taken against them during the said period, NGO and State-wise; and

(f) the steps taken by the Government to monitor the activities/functioning and utilization of funds by these organisations?

(a): As on 18/02/2015, 43050 organisation are registered under Foreign Contributions (Regulation) Act, 2010 (FCRA). The details of foreign contributions received by registered associations during each of the last three years and current year, country and State-wise is given in Annexure-I and Annexure-II respectively.

(b) to (c): Complaints are received from Government agencies and public regarding misutilisation of foreign contribution by NGOs. On the basis of the complaints of violations of FCRA and after conducting enquiries, 24 cases have so far been referred to CBI and 10 cases have been referred to State Police for investigation as given in Annexure III and IV.

(d) to (e): The details of NGOs who have not filed their annual returns are available on Ministry of Home Affairs website http://mha1.nic.in/fcra.htm. During 2012 registrations of 4138 associations under FCRA was cancelled for non-submission of Annual Returns during 2006-07 to 2008-09. The state-wise list of such associations is given in Annexure-V. The list is also available on the aforesaid website.

(f): The various security agencies and the State Governments share information received/gathered by them from various sources. This information in respect of NGOs/Associations is processed to identify prima-facie contravention of FCRA. Based on the information, inspection of records and accounts of the associations is conducted. If after inspection, it is found that the association has violated the provisions of FCRA, action as contained therein is initiated, including cancellation of registration and/or referring the case to CBI/State Police for further investigation and prosecution.
