Question : Protection of Women from Crimes and Harassment

(a) the details of crimes of heinous nature which have been committed during the year 2019-20, State-wise specially in Maharashtra;

(b) the manner in which ‘Nirbhaya Fund’ has been used for the protection of women along with the results thereof; and

(c) the reasons for delay in execution of the declared sentence to the criminals in Nirbhaya Case and the measures for prevention of its delay?

(a) National Crime Records Bureau (NCRB) compiles and publishes information on crimes in its publication “Crime in India”. Published reports are available till the year 2018. The State/Union Territory-wise (including Maharashtra) details of Cases Registered under Henious Crimes for Crimes against Women during 2018 are available at Annexure-I.
(b) The Ministry of Home Affairs is undertaking several initiatives for safety of women in the country through Nirbhaya Fund, details of which are as follows:

i. Emergency Response Support System (ERSS): ERSS is a pan-India, single, internationally recognized number (112) based system for various emergencies, with computer aided dispatch of field resources to the location of distress. ERSS has been operationalized in 28 States/UTs.
ii. Cyber Crime Prevention against Women & Children (CCPWC): The Ministry of Home Affairs has provided grant to all States/UTs to set up cyber forensic cum training laboratories, hiring of Junior Cyber Consultant and training/capacity building to provide hands-on training to Law Enforcement Agencies (LEAs), investigators, prosecutors and judicial officers. MHA launched a portal, www.cybercrime.gov.in for citizens to report obscene content.
iii. Delhi Police projects: MHA is supporting Delhi Police in strengthening of Special Unit for Women & Children (SPUWAC) and Special Unit for North East Region (SPUNER) in Delhi. Delhi Police has recruited Social Workers and Counsellors in Police Stations and Sub-Division level offices to support and counsel women to report crimes without fear. Other activities undertaken include Self Defence Training Camps for Women, ‘Good-Touch/ Bad-Touch’ Training programs in Schools, Gender Sensitization, Gender Communications and Soft Skills training programs for Officers and Women

Safety Awareness programs in crime prone areas of Delhi. Delhi Police has also printed and circulated a Handbook on Investigation of Crimes against Women to its Officers under the project to facilitate timely investigations.
iv. Training of Investigation Officers/ Prosecution Officers/ Medical Officers in forensic evidence and Procurement of Forensic Kits for sexual assault cases: MHA has notified guidelines for collection of forensic evidence in sexual assault cases and the standard composition in a sexual assault evidence collection kit. To facilitate adequate capacity in manpower training and skill building programs for Investigation Officers, Prosecution Officers and Medical Officers has commenced. 8450 Officers have been trained in collection, handling and transportation of forensic evidence. BPR&D has distributed 3,120 Sexual Assault Evidence Collection Kits to States/ UTs as orientation kit as part of training.
v. Central Forensic Science Laboratory (CFSL): A state-of-the-art DNA Analysis Centre has been operationalized on 23.12.2019 at CFSL, Chandigarh. The Laboratory will contribute to addressing the gap in forensic DNA analysis in sexual assault cases in the country.

vi. Strengthening of State Forensic Science Laboratories (FSLs): MHA has sanctioned project for strengthening FSLs in 13 States/UT for setting up DNA analysis labs and Cyber-forensics to facilitate speedy investigations.
vii. Safe City Projects: Safe City projects have been approved in 8 cities in phase I. Safe City project involves development of critical assets in urban areas including infrastructure, technology adoption and capacity building in community through awareness programmes.
viii. MHA has also approved 2 projects, namely, Setting up of Women Help Desks in Police Stations in States/UTs and Setting up Anti-Human Trafficking Units in all districts of the country.

(c) Execution of the declared sentence by court is subject to the legal remedies available to the convicts. As per available information, the court has fixed the date of execution of death warrant in the Nirbhaya case on 20th March 2020.
