Question : Kidney Racket

Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:

(a) whether the Government has taken note of a number of cases of kidney racket across the country;

(b) whether the Government proposes to formulate any policy against the hospitals and doctors involved;

(c) if so, the details thereof;

(d) whether any action has been taken against those involved in such cases; and

(e) if so, the details thereof?

(a): Health is a State subject and steps for prevention and control of any such racket are required to be taken by the State Governments. Whenever a complaint is brought to the notice of Department of Health and Family Welfare, the same is forwarded to States concerned and the Ministry of Home Affairs for action.

(b) & (c): The Government of India has already formulated Transplantation of Human Organs and Tissues Act, 1994 (as amended in 2011). Section 19 of THOTA has provisions for imprisonment for upto ten years and fine upto Rs. 1.00 crore as punishment for commercial dealings in human organs. However the enforcement of provisions of the Act are within the remit of the respective State Government.

(d) & (e): Details of such cases are not maintained centrally in the Ministry of Health and Family Welfare.
