Question : Review of OBC Status

(a) whether there is a provision for reviewing of the status of Other Backward Classes under the National Commission for Backward Classes Act every ten years and change of the provisions relating to reservation as per the financial and social conditions of the said community after the review;

(b) if so, the date on which amendments were made in the National Commission for Backward Classes Act;

(c) whether suggestions on any kind of amendments/modifications in reservation provisions have been received in the current scenario and if so, the details thereof; and

(d) whether any such proposal is under the consideration of the Government and if so, the details thereof?

(a): Yes, Madam, as per Section 11(1) of the National Commission for Backward Classes Act, 1993 the Central Government may at any time, and shall, at the expiration of ten years from the coming into force of this Act and every succeeding period of ten years thereafter, undertake revision of the lists with a view to excluding from such lists those classes who have ceased to be backward classes or for including in such lists new backward classes. Section 11(2) of the said Act also provides that the Central Government shall, while undertaking any revision referred to in sub-section (1), consult the National Commission for Backward Classes.

(b): No such amendments have been made in the NCBC Act, 1993.

(c) & (d): Yes, Madam. The Government has received suggestions from various quarters, though no such proposal to amend the existing policy is under consideration of the Government.
