Question : Compensation to Farmers

(a) the criteria regarding land acquisition for coal mines;
(b) the area of land acquired for Makardhokra mines in Umred area of Western Coalfields Limited;
(c) the number of persons including the land owners and farmers provided compensation for the land acquired from them along with the number of persons who have not been provided this compensation along with the reasons therefor;
(d) the basis on which compensation has been provided for Makardhokra mines under two different Acts (LA and CBA);
(e) the basis of providing compensation regarding land acquisition for one mine under two acts;
(f) the number of farmers or persons demanding such compensation; and
(g) the steps being taken by the Government and the Western Coalfields Limited to provide compensation to the said land owners/farmers?

(a) &(b): The land for coal mines is acquired on the basis of Project Report prepared by Central Mine Planning & Design Institute Limited (CMPDIL). The area of land acquired for Makardhokra mines in Umred area of Western Coalfields Limited are as under:-
(A) Makardhokra-I OC Mine:

(c): The number of persons including the land owners and farmers provided compensation for the land acquired from them along with the number of persons who have not been provided compensation are given below:-

Amount of land compensation of all the land owners whose land has been acquired through District Collector under the provisions of Land Acquisition Act’ 1894, have been disbursed by Spl. Land Acquisition Officer, Nagpur.
Reasons for not providing land compensation are given below:-
i) Amount of land compensation of those land owners whose land has been acquired under the Coal Bearing Areas (Acquisition & Development) Act, 1957 which could not be disbursed to the land owners due to their ownership dispute, share dispute, family dispute or due to pending sub-judice cases in Court etc., has been deposited in Special Tribunal for its disbursement to rightful owners.
ii) 1596 Ha land acquired under Coal Bearing Areas (Acquisition & Development) Act, 1957 for Makardhokra-III OC Project involves 6.33 Ha gaothanabadi (homestead) land which is 0.41% of the total acquired land. Payment of compensation of these homestead owners is pending due to their demands which are beyond norms.
(d) & (e): Land compensation amount for the lands acquired under Land Acquisition Act, 1894 through District Collector, has been determined on the basis of provisions u/s 23, 24 & 25 of the said Land Acquisition Act, 1894. Land compensation amount for the lands acquired under Coal Bearing Areas (Acquisition & Development) Act’ 1957 has been determined on the basis of the land rates declared by Government of Maharashtra through its Resolution dated 22nd August 2012.
(f) & (g): Does not arise in view of reply given at parts (d) to (e) above.
