Question : SOCIAL SECURITY FOR CONSTRUCTION WORKERS



(a)whether the multinational companies and the Indian corporate houses employ workers not on regular basis but on contract basis;

(b)whether the social security guarantee of workers lapse under contract system;

(c)if so, the reactions of the Government thereto;

(d)whether the Government proposes to amend the Labour Laws for providing social security to the workers under contract system; and

(e)if so, the details thereof and if not, the reasons therefor?

(a): Any establishment can employ contract workers in any job or process unless it is prohibited under section 10 of the Contract Labour (Regulation & Abolition) Act, 1970. However, the establishments engaging contract workers have to follow the statutory provisions contained in labour laws.

(b) to (e): No, Madam. There is no such proposal to amend the Labour Laws for providing Social Security to the workers under contract system. Since Social Security benefits to the eligible contract workers are extended under the existing Social Security Legislations i.e. Employees’ State Insurance Act,1948 and Employees’ Provident Fund & Miscellaneous Act,1952.
