Question : Driving Licence for Divyangs

(a) whether the Government has made any provision to issue driving licence to the divyang people;

(b) if so, whether the Government has prescribed the percentage of disability for issuing driving licence to the divyangs;

(c) if so, the number of divyang persons to whom driving licence are likely to be issued in Bihar and Rajasthan;

(d) the procedure to issue driving licence to the divyang people; and

(e) the names of the States where this procedure has been operationalized?

(a) to (e) Yes, Madam. Section 2(18) of the Motor Vehicle Act, 1988 defines an “invalid carriage” as “a motor vehicle specially designed and constructed, and not merely, adapted, for the use of a person suffering from some physical defect or disability, and used solely by or for such a person”. Further, Section 10(2)(c) of the said Act provides for “invalid carriage” as a class for issue of driving licence. The Motor Vehicle Act, 1988, Section 52 provides alteration in Motor Vehicle. The Registering/Licensing Authority in the state issue such driving licence for person with special needs. Further, the Ministry has issued Resolution No. RT-11012/12/01-MVL dated 23.07.2008 which specifies alteration in Motor Vehicles for special requirements. Also the Ministry vide its advisory No. RT-11021/40/2014-MVL dated 14.06.2016 provides guidelines for grant of driving licences and registration certificate to differently abled persons.
